Terms & Conditions

 

INTRODUCTION

​

These Terms & Conditions apply to all VioVoi Music Academy lessons, workshops, programs, and any additional products and/or services offered by Viovoi Music Academy in the future for any child (collectively “Viovoi Music Academy Activities”)

For participation of a child in a VioVoi Music Academy Activity all Parents are required to consent to these Terms & Conditions by signature or by ticking the acceptance box for these Terms & Conditions when submitting an electronic application form online. We may update these Terms & Conditions from time to time.

 

“Term” refers to one normal academic term of Voivoi Music Academy during which weekly lessons are conducted.

“Term Dates” refers to the dates for the relevant Term.

1. ADMISSION OF A NEW STUDENT

• To apply for a slot for a new student in a program at VioVoi Music Academy, the Parent/Guardian must agree to these Terms & Conditions and submit an application form online, by post or in person.

• All lessons must be paid for in advance

• A slot for a student is reserved only after the registration and payment are confirmed.

 

2. FEE PAYMENTS AND REFUNDS

• The due date for payment of fees is before the 7th of each month. A late fee of Rs.500 per  month of delay will be charged thereafter.

• Repeated late payment will result in cancellation of student admission enrollment.

• We do not provide refunds.

• For lessons canceled by the Academy for any reason, the fee is covered by a lesson taken to compensate which can be in the form of a concert rehearsal, workshop or a session from an alternate teacher.

• Students must commit to attending the lessons they have purchased or forfeit the remaining fees should they choose to discontinue lessons mid-month.​

3. CANCELLATION AND NON-ATTENDANCE
 

• In case a student doesn’t attend one or more sessions during a workshop or an ongoing program no extra sessions or fee refund will be given.

• If the participant fails to attend the workshop/program, the full course fees are still payable.

• Viovoi Music Academy reserves the right to cancel any session and offer the option to attend on an alternative date.

• Students who are irregular with attendance or miss 3 lessons consecutively without informing the teacher in advance will lose their regular lesson slot. Please check if another slot is available.

 

4. TRIAL PERIOD

• VioVoi Music Academy does not offer a trial period.

• For some workshops there may be a demo-session offered on a first-come-first-served basis.

 

5. USE OF PERSONAL INFORMATION

​

• The personal data of a Child and/or Parent submitted using the application form will be processed by Viovoi Music Academy for the purposes of administration and research, in relation to the provision of teaching services in music.

• Viovoi Music Academy will share this information with external agencies (for example organisations with responsibility for children’s safeguarding) only when required or permitted to do so by law.

• Viovoi Music Academy will not disclose personal data to third parties for marketing purposes although Viovoi Music Academy may use personal data for their own marketing and business development purposes, including for the purposes of advertising and promoting new products and/or services by Viovoi Music Academy.

• Parents who do not wish to receive marketing communications from Viovoi Music Academy should inform Viovoi Music Academy in writing.

• Viovoi Music Academy will from time to time take photographs and film footage of Children during Programs/Workshops and performances for use in Viovoi Music Academy marketing and publicity material. Permissions are sought upon registration to Viovoi Music Academy activities.

• Viovoi Music Academy owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any Workshop/Program which is owned by Viovoi Music Academy.

 

6. HEALTH AND INJURIES

• Children participate at their own risk and are obliged to inform Viovoi Music Academy and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to Viovoi Music Academy immediately in writing.

• If you are unsure whether a Child should participate in any activity please consult the child’s GP before enrolling the Child on a Viovoi Music Academy Activity.

• Children must wear suitable footwear and clothing at all times.

• If a Child is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided below or on the enrollment form. This number must always be contactable whilst the child is attending the VioVoi Music Academy Activity.

• Parents are solely responsible for ensuring that the emergency contact details on Viovoi Music Academy's records are up to date.

• Students are feeling unwell (have a cold/fever etc.) must opt to attend their lesson online.

 

7. PERSONAL PROPERTY

​

• Children are obliged to take care of their own belongings. Viovoi Music Academy can accept no liability for lost or damaged belongings.

• You acknowledge that the maximum aggregate liability of Viovoi Music Academy to a Child or Parent under these Terms & Conditions shall not exceed the Viovoi Music Academy Activity fee to which a claim relates.

• The liability of Viovoi Music Academy and that of its staff is restricted to class time only and then only to gross negligence.

12. ONLINE SESSION SUPERVISION​

​

• Parents agree to allow their children to attend VioVoi Music Academy Activities online only under their supervision.

13. GENERAL

​

• Viovoi Music Academy reserves the right to offer admission to students meeting the conditions stated above.

• Viovoi Music Academy reserves the right to make changes to the timetable and to the teaching staff from the advertised programme in the event of illness or other circumstances beyond our control.

• Each student is offered 44 lessons in a year, for which the fees is collected on a monthly or bi-monthly basis.

• On occasion, a lesson may be rescheduled subject to availability and discretion of the teacher for a another lesson during the same week of the originally canceled lesson. 

• A lesson once rescheduled cannot be rescheduled a second time.

• For lessons canceled by the Academy for any reason, the fee is covered by a lesson taken to compensate which can be in the form of a concert rehearsal, workshop or a session from an alternate teacher.

• In the event that a child is unable to attend a Viovoi Music Academy lesson, due to sickness, holiday or a decision by the parent or child not to attend, Viovoi Music Academy regrets that it is unable to refund any payment.

• All children must be collected on time after a session. Viovoi Music Academy is unable to supervise children after a session.

• Viovoi Music Academy fees are reviewed annually and may be increased in July of each year.

• These Terms & Conditions, together with any registration form complete, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

• In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.

• These Terms and Conditions shall be governed by and construed in accordance with the laws of Government Of India.
